Welcome to Nourishing Hearts Wellness Care Farm. These Terms and Conditions ("Terms") govern your access to and use of our website located at nourishinghearts.ca (the "Website") and the general services provided by Nourishing Hearts Wellness Care Farm ("Nourishing Hearts," "we," "us," or "our").

By accessing our Website or visiting our farm, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Website or services.
 

1. No Medical or Psychological Advice (Disclaimer)

The content provided on this Website (including text, graphics, images, and informational materials) is for educational and informational purposes only. It does not constitute professional medical, psychological, or psychiatric advice, diagnosis, or treatment.

Accessing this Website or communicating with us via email or contact forms does not establish a therapist-client relationship.

A formal therapist-client relationship is only established after completing necessary intake forms, signing an Informed Consent document, and having an initial consultation with our Registered Social Worker (RSW).

If you are experiencing a medical or mental health emergency, please immediately call 911 or go to your nearest emergency department.
 

2. Clinical Services and Separate Consents

Nourishing Hearts provides social work-based therapeutic services, including Individual Counselling, Animal-Assisted Therapy (AAT), Nature-Assisted Therapy, and Play Therapy.

Participation in any clinical or therapeutic service requires the execution of separate, legally binding documents, including an Informed Consent for Treatment and a Liability Waiver, which will be administered securely through Owl Practice.

The terms of those specific clinical agreements will supersede these general Website Terms where there is a conflict.
 

3. Farm Environment, Assumption of Risk, and Safety

Our services are provided on a working family farm in Ontario. By visiting the physical premises, you acknowledge and agree to the following under the Occupiers' Liability Act (Ontario) and general principles of assumption of risk:

Inherent Risk: Interacting with farm animals (horses, goats, pigs, sheep, cats, etc.) and navigating a farm environment involves unpredictable risks. Animals may bite, butt, kick, scratch, or cause injury without warning. The terrain may be uneven, wet, or slippery.

Voluntary Assumption: You voluntarily assume all risks, known and unknown, associated with visiting the farm, interacting with the animals, and engaging in nature-based activities.

Supervision: Minors and dependents must be strictly supervised by their parent or guardian at all times unless participating in a direct 1-on-1 therapy session with Nourishing Hearts staff.

Allergies and Medical Conditions: Our farm contains animals, hay, dust, pollen, and other environmental allergens. It is your strict responsibility to prepare for any allergies or medical needs (e.g., carrying an EpiPen). Nourishing Hearts accepts no liability for allergic reactions or environmental exposures.

Clothing: You are responsible for wearing appropriate clothing and closed-toe footwear suitable for a working farm environment.
 

4. Appointments, Cancellations, and Funding

Booking: Clinical appointments are managed through Owl Practice, a secure practice management solution.

Cancellation Policy: We require a minimum of 24 hours' notice for the cancellation of any scheduled session. Failure to provide sufficient notice may result in a cancellation fee equivalent to the full session cost, which cannot be billed to insurance.

Funding and Payments: While our services are frequently covered by private insurance, the Ontario Autism Program (OAP), and Non-Insured Health Benefits (NIHB), clients are ultimately responsible for ensuring active funding coverage and paying any fees or balances not covered by third-party providers.

5. Facility Rentals (Gathering Space & Commercial Kitchen)

Rentals of the Gathering Space and the Commercial Kitchen (opening Spring 2026) are subject to specific, separate rental agreements, health and safety guidelines, and liability waivers.
 

6. Intellectual Property

All content on this Website (text, photographs, logos, program names like The Dragonfly Club) is the exclusive property of Nourishing Hearts Wellness Care Farm and is protected by Canadian and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content without our prior written, express consent.
 

7. Limitation of Liability and Indemnification

Limitation of Liability: To the fullest extent permitted by law, Nourishing Hearts Wellness Care Farm, its owners, employees, volunteers, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of: (a) your access to or use of the Website; (b) any errors or omissions in the Website content; or (c) any injury, loss, or property damage sustained while visiting the farm, except in cases of our gross negligence or willful misconduct.

Indemnification: You agree to indemnify, defend, and hold harmless Nourishing Hearts Wellness Care Farm and its personnel from and against any and all claims, liabilities, damages, and expenses (including legal fees) arising from your use of the Website, your violation of these Terms, or your conduct while on Nourishing Hearts' premises.
 

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal action or proceeding arising out of or related to these Terms or your use of the Website/services shall be brought exclusively in the courts of Ontario.
 

9. Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting to the Website.
